Privacy Policy

Happy Scaling LLC (“Happy Scaling,” “we,” “us”) operates happyscaling.com and happyscaling.co (together, the “Site”). This policy explains what personal information we collect through the Site, our newsletter, and calls with prospective clients; how we use it; who we share it with; and the choices you have.

This policy does not cover information shared with us as a client. If you become a client, our engagement agreement governs how we handle information you share with us in that relationship.

1. Information we collect

Information you give us.

  • Newsletter sign-up: your email address and, if you provide it, your name.

  • Booking a call: your name, email address, the time you choose, and any answers you give on the booking form, such as your company or what you’d like to discuss. We add you to our newsletter only if you opt in.

  • Contact forms, email, and messages: whatever you include when you write to us.

Information collected automatically. When you visit the Site, we and our service providers collect:

  • Device and usage data: IP address, browser type, device type, operating system, referring page, pages viewed, time on page, and approximate location derived from your IP address.

  • Cookies and similar technologies: small files and scripts that recognize your browser across visits. See Section 4.

Information from calls. If you book and attend a call with us, we may record and transcribe it using an AI meeting assistant (see Section 3). Recordings, transcripts, and summaries contain what was said on the call.

We do not knowingly collect sensitive personal information, such as government ID numbers, financial account numbers, or health information, through the Site. Please don’t submit it.

2. How we use your information

We use personal information to:

  • Send you the newsletter you subscribed to.

  • Schedule, hold, and follow up on calls you book.

  • Respond to your inquiries and manage our relationship with you, including keeping records in our customer relationship management (CRM) system.

  • Search, summarize, and organize our business records, including with AI tools.

  • Understand how visitors use the Site so we can improve it.

  • Measure the effectiveness of our advertising and show relevant ads to past visitors on other platforms, such as Facebook and Instagram.

  • Protect the Site against fraud and abuse, and comply with legal obligations.

3. Who we share information with

We do not sell your personal information for money. We share it only as described below.

Service providers that process data on our behalf, by category:

  • Website hosting provider: Hosting the Site, forms, and site analytics

  • Email service provider: Newsletter delivery and subscriber management

  • Scheduling provider: Call scheduling

  • Video conferencing providers: Video calls

  • AI meeting assistant: Call recording, transcription, and summaries

  • Productivity and communication platforms: Email, calendar, and internal and client messaging

  • Workflow automation provider: Moving form and booking data between our systems

  • CRM provider: Our records of contacts, conversations, and call notes

  • AI service providers: Searching, summarizing, and organizing our business records, including CRM data

Advertising and analytics partners:

  • Google (Google Analytics and Google tags) collects usage data to provide analytics and, if enabled, to measure Google Ads. Google may use this data according to its own policies: policies.google.com/technologies/partner-sites.

  • Meta (the Meta Pixel) collects data about your visit, such as pages viewed and actions taken, so we can measure our ads and show relevant ads to people who have visited the Site. We do not send the contents of forms you fill out on the Site to Meta. Meta may combine Pixel data with information it already holds about you. See facebook.com/privacy/policy.

These partners may collect information about your online activity over time and across different websites.

Some U.S. state laws treat this kind of advertising data sharing as a “sale” or “sharing” of personal information even when no money changes hands. You can opt out at any time; see Sections 4 and 5.

Call recording. Calls with us may be recorded and transcribed by an AI meeting assistant. You will be notified when the notetaker joins, and it appears as a visible participant. If you don’t want a call recorded, tell us before or at the start of the call and we will remove the notetaker. Recordings, transcripts, and summaries are stored with that provider and in our CRM.

AI tools. We use AI tools to transcribe and summarize calls and to search, summarize, and organize information in our business systems, including our CRM. These providers process your information on our behalf. We use these tools under settings or terms that do not permit the provider to use your information to train its AI models. We do not use AI to make decisions about you that have legal or similarly significant effects.

Other disclosures. We may disclose information if required by law, to protect our rights or the safety of others, or as part of a merger, acquisition, or sale of our business. In a sale, the acquirer would be bound by this policy for information collected under it.

4. Cookies and tracking

We use:

  • Strictly necessary cookies, which make the Site work. These cannot be turned off.

  • Analytics cookies (Google Analytics), which show how the Site is used.

  • Advertising cookies and pixels (Meta Pixel, Google ad tags), which measure ads and show ads to past visitors.

How consent works depends on where you are.

  • If you are in the European Economic Area, the United Kingdom, or Switzerland, analytics and advertising cookies load only after you agree through our cookie banner.

  • Everywhere else, these cookies load when you visit the Site, and you can turn them off at any time.

Wherever you are, you can change your choice at any time using the “Cookie settings” link in the Site footer.

Our booking page is provided by Calendly. When you use it, Calendly may collect information and set cookies under its own privacy notice: calendly.com/legal/privacy-notice.

Do Not Track. Browsers’ Do Not Track signals have no common industry standard, and we do not respond to them.

5. Your choices and rights

Everyone can:

  • Unsubscribe from the newsletter with the link in any issue.

  • Ask for a copy of the personal information we hold about you, or ask us to correct or delete it.

  • Opt out of advertising cookies through “Cookie settings” or by emailing us.

  • Ask us not to record a call with you.

To make a request, email privacy@happyscaling.com. We may need to verify your identity before acting on it, and we will respond within 30 days. We will not treat you differently for exercising these rights.

If you are in the EEA, UK, or Switzerland, you also have the right to object to processing, to restrict processing, to data portability, and to withdraw consent at any time. You can also lodge a complaint with your local data protection authority. Our legal bases are:

  • Consent: sending the newsletter, and analytics and advertising cookies.

  • Performance of a contract, or steps you request before one: scheduling and holding calls.

  • Legitimate interests: recording and summarizing calls for accurate records; using AI tools to organize and summarize our business records; responding to inquiries; maintaining records of clients and prospective clients; and securing the Site.

6. International transfers

We are based in the United States, and our service providers operate in the United States, the European Union, Israel, and elsewhere. If you access the Site from outside the U.S., your information will be transferred to and processed in the U.S. and other countries. Where required, we rely on safeguards such as the EU-U.S. Data Privacy Framework or the European Commission’s Standard Contractual Clauses.

7. Data retention

We keep personal information only as long as reasonably necessary for the purposes described in this policy. In deciding how long that is, we consider whether we have an ongoing or potential business relationship with you, the nature of the information, our legal, tax, and accounting obligations, and the need to resolve disputes and enforce our agreements.

If you unsubscribe from the newsletter, we keep a record of your email address and unsubscribe status so we don’t email you again, unless you choose to resubscribe.

Google Analytics data is retained for 14 months. Advertising data held by Meta and Google is governed by their own policies.

8. Security

We use reasonable administrative and technical safeguards, including access controls and multi-factor authentication on the systems that hold your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children

The Site is intended for business professionals. It is not directed at children under 16, and we do not knowingly collect their personal information. If you believe a child has given us personal information, contact us and we will delete it.

10. Changes to this policy

We may update this policy. We will post the new version on this page with a new effective date. If the changes are material, we will also notify newsletter subscribers by email.
